Custom Rail – PVC with Aluminum Insert LIMITED LIFETIME WARRANTY

LIMITED LIFETIME WARRANTY COVERAGE.  Worthington Millwork warrants its Custom Rail subject to the following terms, conditions and limitations.  Worthington warrants its rail product against cracking, peeling, flaking, rotting, blistering, delamination, or fading, in excess of stability and weatherability standards commonly accepted in the industry at the time of manufacture.  Should any of the foregoing defects occur while the original purchaser retains ownership of the property where the rail product was originally installed, Worthington Millwork will, at its sole and exclusive option under this warranty, provide a replacement rail product or return the purchase price of the product.  Labor costs incurred in removing defective rail product or installation the replacement rail product are not covered by this warranty.  This warranty shall only apply to the original purchaser and is not transferable to any other person or entity and is the sole and exclusive warranty provided by Worthington Millwork, LLC.

Replacement parts may vary slightly in color or gloss in comparison to the original rail product.  Worthington shall not be liable as a result of such variance.  Worthington Millwork reserves the right to discontinue or change the rail product design or color without notice.  If the original type or color of rail product covered by this Limited warranty is not available, Worthington Millwork will substitute a product that, in Worthington Millwork’s sole discretion, is of equal value and quality, or Worthington may elect to return the original purchase price of the product.

LIMITATIONS, CONDITIONS NOT COVERED BY THIS WARRANTY – This limited lifetime warranty applies and is effective only if the rail product is properly installed in accordance with Worthington Millwork’s installation instructions and subject to normal use and exposure.  This Limited Lifetime Warranty does not cover, and shall automatically become null and void, for the following reasons: (i) abuse; (ii) misuse; (iii) accident; (iv) improper storage, installation, application, or maintenance; (v) casualty or act of God; (vi) failure to use product in accordance to Worthington Millwork’s specifications and installation practices; or, (vii) application of paint, varnish, or any other substance over the manufacture’s original finish.  This Limited Lifetime Warranty only applies to rail product purchased and used by individual homeowner’s or residential property, all other rail product used by other entities on non residential property is warranted for 20 years from the date of installation.

THIS WARRANTY IS EXCLUSIVE, AND EXCEPT AS EXPRESSLY SET OUT IN THIS WARRANTY, WORTHINGTON MILLWORK MAKES NO OTHER WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AND DISCLAIMS ALL OTHER WARRANTIES, INCLUDING AN IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICUALR PURPOSE, OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.  FOR A PARTICUALR PURPOSE, OR ARISING FROM A COURSE OF DELAING OR USAGE OF TRADE.  WORTHINGTON MILLWORK NEITHER ASSUMES, NOR AUTHORIZES ANY OTHER PERSON TO ASSUME (INCLUDING ANY DISTRIBUTOR, BUILDER, OR INSTALLER), ANY OTHER OBLIGATION OR LIABILITY OR TO MAKEANY ADDITIONAL WARRANTY IN CONNECTION WITH THE SALE, INSTALLATION OR USE OF THE RAIL PRODUCT.  WORTHINGTON MILLWORK SHALL UNDER NO CIRCUMSTANCES, WHETHER FOR A FAILURE OF ITSLIMITED REMEDY OR OTHERWISE, BE LIABLE FOR SPECIAL, INCIDENTAL, DIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES.  THE EXCLUSIVE REMEDY UNDER THIS WARRANTY IS LIMITED TO THE EXPRESS REMEDY SET FORTH ABOVE.  NO WAIVER, ALTERATION, ADDITION OR MODIFICATION OF THE FOREGOING CONDITIONS SHALL BE GRANTED UNLESS MADE IN WRITINGAND SIGNED BY AN OFFICER OF WORTHINGTON MILLWORK, LLC.
